The agreement
Terms of Service
The agreement between you and Hoot & Lune when you use this site or buy from it. Please read it, especially the arbitration section.
Last updated: September 30, 2026
Important: section 15 says that most disputes between you and Hoot & Lune are settled by binding individual arbitration, not in court, and that you give up the right to take part in a class action. You can opt out within 30 days, as explained there.
1. Who we are and when these terms apply
This site is run by Hoot & Lune (“we”, “us”, “our”). These Terms of Service apply whenever you visit hootandlune.com, create an account, or place an order. By using the site or placing an order you agree to these terms and to our Privacy Policy, Shipping and Returns policies, which form part of this agreement. If you do not agree, please do not use the site.
2. Who can buy
You must be at least 18, or the age of majority where you live, to place an order. If you are younger, a parent or guardian must place the order and accept these terms. The site is not directed at children under 13.
3. Accounts
Give us accurate details and keep them up to date. Keep your password and sign-in methods secure; you are responsible for everything done under your account. Tell us straight away if you think someone else has used it. We may suspend or close an account that breaks these terms, is used for fraud, or is used to abuse the shop or its staff.
4. Products are made to order
- Every item is printed on demand after you order it, by an independent print partner working through Printify.
- Product photos are mockups. Colours on screen, print placement and garment shade can vary slightly from the image, and between print runs. Small variations of this kind are not defects.
- Sizes follow the size chart on each product page. Please check it before ordering, as change-of-mind returns are not accepted.
- Follow the care label. We are not responsible for wear, fading or damage caused by washing, drying or use against the care instructions.
5. Orders
Your order is an offer to buy. A contract is formed when we take payment and send your order to print. We may refuse or cancel any order, before or after payment, including where an item is unavailable, a price or description was wrong, we suspect fraud or misuse, the delivery address cannot be served, or we reasonably believe the order breaks these terms. If we cancel an order you have paid for, we refund you in full, and that refund is the full extent of our responsibility for the cancellation.
6. Prices and payment
- Prices are in USD. Shipping and any sales tax are added at checkout and shown before you pay.
- We try to keep every price correct. If an item is listed at the wrong price, we may cancel the order and refund you, or contact you with the correct price, even after we have confirmed it.
- Payments are handled by Stripe. By paying, you confirm you are allowed to use the payment method.
- Import duties, customs fees and taxes charged by the destination country are paid by the buyer.
- Discount codes have no cash value, cannot be combined unless we say so, and may be withdrawn at any time.
7. Shipping and risk
Delivery times shown at checkout and on the Shipping page are estimates, not guarantees. Delays caused by printers, carriers, customs, weather or other events outside our control are not a breach of these terms. Please enter your address carefully: we are not responsible for parcels sent to an address you gave us incorrectly. Title and risk of loss pass to you when the parcel is delivered to that address.
8. Returns, cancellations and refunds
Misprinted, damaged, defective or wrong items are covered as described on the Returns page, and you must tell us within 30 days of delivery. Because each piece is made for you, we do not accept returns for change of mind or the wrong size ordered. Orders can only be cancelled before they go into production. Please contact us before disputing a charge with your bank; we are usually able to put things right faster.
9. Our designs and intellectual property
All designs, artwork, photos, text, logos and other content on this site belong to Hoot & Lune or its licensors and are protected by copyright and trademark law. Buying a product gives you ownership of that physical item only. It does not give you any right to copy, reproduce, resell, adapt or use the artwork or the Hoot & Lune name for any other purpose, including on other products or for commercial use.
10. Acceptable use
You agree not to:
- copy, scrape or harvest the site or its content, or use bots or automated tools against it;
- try to break, overload, probe or get around the security of the site or its payment process;
- place fraudulent orders, misuse discount codes, or use a payment method you are not authorised to use;
- send anything unlawful, abusive, harassing or infringing through the contact form or any other feature;
- use the site in any way that breaks the law.
11. Things you send us
If you send us messages, feedback, ideas or suggestions, you allow us to use them to run and improve the shop without paying you or crediting you. Please do not send us anything confidential or that you do not have the right to share.
12. Disclaimer
Except as stated on our Returns page, and to the fullest extent the law allows, the site and all products are provided “as is” and “as available”. We disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the site will always be available, error-free or free of harmful components.
13. Limitation of liability
To the fullest extent the law allows: (a) Hoot & Lune is not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising from the site, a product or these terms, even if we were told such damages were possible; and (b) our total liability for any claim relating to an order is limited to the amount you paid for that order, and for any other claim to one hundred US dollars (US$100). Some places do not allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms removes rights you have under consumer protection law that cannot legally be removed.
14. Indemnity
You agree to defend and indemnify Hoot & Lune against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or your breaking any law or the rights of someone else.
15. Disputes: binding arbitration and class action waiver
Talk to us first. Before starting any claim, write to us through our contact form with your name, order number (if any), a description of the problem and what you want. Both of us agree to try in good faith to settle it within 60 days.
Arbitration. If we cannot settle it, you and Hoot & Lune agree that any dispute or claim relating to the site, a product, an order or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. The Federal Arbitration Act governs this section. The arbitrator decides all issues, including whether a claim must be arbitrated, except as stated below. Arbitration may take place by video or phone, or in the county where you live. Fees are paid as the AAA Consumer Rules require.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may ask a court to stop the infringement or misuse of intellectual property.
No class actions. You and Hoot & Lune each bring claims only individually, not as a plaintiff or class member in any class, collective, consolidated or representative action, and the arbitrator cannot combine claims of more than one person. You and we both waive any right to a jury trial. If this class action waiver is found unenforceable for a claim, that claim must be heard in court, not in arbitration, and the rest of this section still applies.
Opting out. You can opt out of this arbitration agreement by writing to us through our contact form within 30 days of first accepting these terms, with your name, email address and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these terms.
Time limit. To the extent the law allows, any claim must be started within one year after it arises, or it is permanently barred.
16. Governing law and courts
These terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict of law rules. Any claim that is not subject to arbitration will be brought only in the state or federal courts located in Florida, and you and we consent to their jurisdiction. If you live outside the United States, mandatory consumer protection laws of your country still apply to you where they cannot be excluded.
17. Events outside our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, epidemics, war, strikes, carrier or supplier failures, internet or power outages, and government action.
18. Other terms
- If any part of these terms is found unenforceable, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these terms. We may transfer ours, for example if the shop is sold.
- These terms, together with the policies linked above, are the whole agreement between you and us about the site and your orders.
19. Changes to these terms
We may update these terms from time to time and will change the date at the top when we do. The version published when you placed an order applies to that order. Continuing to use the site after a change means you accept the new version.
